What is a Kansas Employment Contract?

A Kansas employment contract is a legally binding contract that is entered into by an employer and an employee who agrees to work for the employer. The agreement will outline the terms and conditions surrounding employment.

A typical employment contract will address issues like:

  • Job duties
  • Working hours
  • Benefits
  • Company policies
  • Causes for termination

Kansas is an “at-will” employment state so without a valid employment agreement, employers have the freedom to fire employees without reason. A well written employment contract can protect an employee’s job by limiting an employer’s ability to terminate employment.

Are Employment Contracts Enforceable in Kansas?

Yes. Employment contracts are enforceable in Kansas. This even goes for the more restrictive employment contracts like non-compete agreements and non-disclosure agreements. Kansas Courts generally do not interfere with individual’s rights to enter a contract.

A restrictive covenant will become unenforceable in Kansas if the agreement is unreasonable or adversely affects public welfare. The restrictive clause must protect a valid business interest and not impose an undue burden on the employee.

What Are the Legal Requirements for Kansas Employment Contracts?

The laws governing Kansas employment contracts can be found in the Employment agreements section of the Kansas Statutes. Kansas does not require employment contracts to be written. Oral and implied contracts can be enforceable in a Kansas court.

When a contract is oral or implied, it is much more difficult to prove in court. Instead of having a written contract as evidence, the parties will need to testify to the terms and conditions of the oral or implied contract. For these reasons it is always recommended to have a written employment agreement.

What's probationary period in an employment contract?

I am a recent college graduate who recently accepted a job offer from a company. As part of the offer, I was asked to sign an employment contract. I understand that the contract includes a probationary period, but I'm not sure what that entails. I would like to know what the probationary period is and what it means for me as an employee.

A period of time to evaluate you and to show that you're a good fit for the job and that you are fully qualified for it. At the end of the probationary period, they will either keep you on or terminate you.

What's the termination clause in an employment contract?

I recently accepted a position at a company and they have given me an employment contract to review. I have been reading through the contract and noticed a section regarding termination. However, I am not sure what the termination clause in the contract states and I am hoping to get some clarification from a lawyer. I want to make sure that I understand my rights and obligations before signing the contract.

Can my employer change the terms of my employment contract without my consent?

I have been working for a company for the past three years, and my employment contract clearly outlines my job responsibilities, salary, and benefits. However, recently my employer informed me that they are planning to make changes to my contract, including reducing my salary and removing certain benefits. I am concerned about the legality of these changes and whether my employer can modify the terms of my contract without my consent.

I'm sorry to hear about this proposed change. Whether or not your employer can make such changes unilaterally depends almost entirely on how your contract is written. For example, if your contract clearly states that you are an "at will" employee, your employer can not only make whatever changes it wants, but can also discipline you or terminate you with no reason at all and only a one second advance notice. If it's not an "at will" contract, there may be a paragraph or two that addresses amendments to the agreement - eg, some such contracts may say that an employer can make changes with two weeks advance written notice; another may say that changes will be negotiated in advance between employer and employee. You may want to have an employment attorney, such as myself, review your contract as well as any recent correspondence you may have received from your employer. You may also want to try to very quietly try to find out whether or not other employees are possibly in the same boat as you - it's possible that the employer is cutting back on some benefits to save money, rather than laying off or terminating some or all of their employees. Can an employer change the terms of employee benefits without providing notice or obtaining consent?

I work for a small company that has recently made some changes to our employee benefits package without any prior notice or consultation with the employees. The changes include reducing the amount of paid time off, increasing the employee contribution for health insurance, and eliminating certain retirement benefits. I am concerned about the legality of these changes and whether the employer has the right to alter the terms of our benefits without providing any notice or obtaining our consent.

If you have an employment contract, the employer must adhere to the terms of that agreement. Similarly, if the company has an employee handbook, changes to benefits must align with the policies outlined therein. Courts may consider an employee handbook as a binding contract if it creates an expectation of certain benefits. If your benefits are guaranteed in a written contract or employee handbook and the employer did not follow proper procedures to make changes, you may have a claim for breach of contract. Employers are generally encouraged to provide clear communication and advance notice of benefit changes to maintain trust and compliance with legal and policy obligations.
