What is a Missouri Employment Contract?

A Missouri employment contract is a legally binding agreement entered into by an employer and an employee. The contract will outline details like the duties of the new employee, compensation, company policies, and causes for termination. Many employers also include non-competition and non-disclosure clauses to protect their business interests.

Missouri follows the employment-at-will doctrine. This means that an employer can fire an employee without reason at any time. A valid employment contract will supersede at will employment laws and provide protections for employees.

Are Employment Contracts Enforceable in Missouri?

Employment contracts are enforceable in Missouri if they adhere to the contract and non-compete laws in Missouri’s Labor and Industrial Relations statutes. It is common for basic provisions like duties, salary, and reasons for termination to be enforced as long as the terms do not violate laws or public policy.

Non-compete agreements are subject to more restrictive laws and are only enforced in limited circumstances. To be enforced, a non-compete clause must meet the following requirements:

  • Be reasonable in regard to duration and geographic boundary
  • Narrowly tailored to protect the interests of the business
  • Restrictions can only protect trade secrets and customer contacts

What Are the Legal Requirements for Missouri Employment Contracts?

All employment contracts should be in writing, however the legal requirements in Missouri allow oral employment contracts to be enforceable as well. The only caveat is that if a contract’s terms cannot be completed in year, it is subject to the Statute of Frauds and must be in writing.

This means that oral employment contracts for short-term jobs and employment can be enforced but a written agreement will most likely be necessary for permanent employees.

What is fixed term employment contract?

I have been given a contract that says 'Fixed Term Employment Contract'. How is this different than a normal employment contract? Is there anything I need to consider before signing this?

What's termination notice in an employment contract?

I recently accepted a job offer with a new company and I was given an employment contract to sign. I was looking through the contract and noticed that it mentions something about a termination notice. A termination notice is a provision in an employment contract that specifies the amount of notice an employer must give an employee if they wish to terminate the contract, or vice versa if the employee wishes to leave. This is an important clause, as it offers some level of job security for the employee and some level of predictability for the employer. In most states, including North Carolina, employment is considered "at-will" unless there is a contract in place that states otherwise. This means that either the employer or the employee may terminate the employment relationship at any time, for any reason, or for no reason at all, as long as the reason isn't illegal (like discrimination). If your contract includes a termination notice clause, this "at-will" status is likely modified to some extent. The specific details would depend on the exact wording in your contract. It could require either party to provide a notice (often 2 weeks, 1 month, or sometimes longer) before terminating the contract. That notice period is intended to give the other party time to adjust plans accordingly. For the employee, it might mean finding a new job; for the employer, it might mean finding a replacement.
