What is a Louisiana Employment Contract?
A Louisiana employment contract is a legally enforceable agreement executed by an employer and a party the employer is hiring to work. These contracts are generally used for permanent employee’s, but can also be used by employers when hiring short-term employees, contractors, and freelancers.
Are Employment Contracts Enforceable in Louisiana?
Basic employment contracts are enforceable in Louisiana as long as the contract abides by applicable contract laws and does not violate any laws or public policy. These types of employment contracts cover employee duties, salary, benefits, and causes for termination.
Restrictive employment contracts like non-competition agreements are more difficult to enforce in Louisiana. Courts disfavor these types of restrictive covenants and place strict requirements of the terms and conditions. Non-compete agreements that are overly broad, or unreasonable in regard to duration or geographic location will not be enforced.
What Are the Legal Requirements for Louisiana Employment Contracts?
Louisiana recognizes three types of employment contracts: written, oral, and implied.
- Written contract. This is the easiest contract to enforce because the physical written contract serves as evidence of the terms and conditions.
- Oral contract. Although more difficult to prove, oral contracts are enforceable if a party can show that all elements of a contract (offer, acceptance, and consideration) were present at the time of the agreement.
- Implied contract. An implied contract is established based on the conduct and actions of both parties.

What's vacation time in an employment contract?

What's paid time off in an employment contract?
I am a recent college graduate and I am in the process of negotiating an employment contract with a large company. I am trying to make sure I understand the terms of the contract, including the paid time off that is offered. I am hoping to get a better understanding of what's included in the paid time off section of the contract so I can make an informed decision about the offer.

Paid Time Off (PTO) is essentially days (or even hours) that the employee is not required to work but the employer still pays the employee for those hours. It can be awarded in a lump sum in advance, or earned and accumulated over time, dependent on the terms of the employment agreement. PTO may be granted in addition to or in lieu of vacation days, sick days, etc, again depending on the unique employment agreement.
