Is a Non-Compete Agreement Enforceable in Idaho?
Yes. Under Idaho state law, non-compete agreements can be enforceable as long as the agreement adheres to certain conditions.
- Key employee. Non-compete agreements can only be entered into by key employees. Under Idaho laws, a key employee is an employee who has gained intimate knowledge of the business and its operations through training and exposure to confidential materials.
- Legitimate business interest. The non-compete agreement must protect a legitimate business interests like an employer’s goodwill, intellectual property, methods of operation, and other confidential business information
- Geographic area. The contract must designate a geographical area in which the employee provided services or had a business presence.
- Non-compete agreements must be reasonable in that they cannot be more restrictive than necessary to protect the employer’s business interests.
How Long Does an Idaho Non-Compete Agreement Last?
Idaho labor statutes have limited the duration of a non-compete agreement to eighteen months. Non-compete agreements go into effect on the day that employment is terminated.
How Do You Get Around a Non-Compete Agreement in Idaho?
Idaho state statutes grant courts relatively generous freedom to modify non-compete agreements. If a non-compete agreement is unreasonable, a court can edit the contract as necessary to render it reasonable and enforceable. For this reason, non-compete agreements can be difficult to get around in Idaho.
Instead of attempting to get around or beat a non-compete agreement, employees can persuade the courts to edit the agreement to make it less restrictive and more fair for the employee.
What Voids a Non-Compete Agreement in Idaho?
A non-compete agreement in Idaho will be void if it is overly broad and unreasonable and cannot be edited by the courts to be ruled reasonable. In addition, non-compete agreements that are not in writing and signed will also be ruled void.

Noncompete agreement and moonlighting?
I am an employee at a company that has recently asked me to sign a noncompete agreement. I am considering doing so, but I am concerned about whether or not the agreement would prevent me from taking on additional freelance work outside of my normal job. I am interested in moonlighting and need to know if a noncompete agreement would limit my ability to do so.

Can I work for a competitor with my current noncompete?
I have ended my non competent consulting agreement with my current employee and I have an offer to work as an employer “not as consultant” with a competitor company to my privious employees so can I work as an employee without any problem? The consultant agreement says the following: Under any circumstances the consultant shall not engage directly or indirectly either as a principal agent , consultant,stock holder , partner or in any other capacity whatsoever have any other relationship with any business which compete with the company in USA.

Yes, the parties to contracts can always agree to amendments and waivers. However, the former employer may have no interest in waiving the contract in this particular situation.
